By using the App you are indicating that you have read and understood these Terms and you consent to be bound by these Terms.
We reserve the right to amend the provisions of these Terms at any time.
Cube ACR B2B is an application intended to record outgoing and incoming cellular and VoIP calls and provides facilities for convenient management of recordings, such as commenting, cloud upload, searching for recordings, marking important parts of the conversation, etc. It also allows notifying a third party about miscellaneous events in the recording process.
In accordance with these Terms, Provider does not grant you the exclusive, transferred and irrevocable right to access and use the App.
In the relationship between Provider and you, according to the assumptions in the Terms, Provider will have all rights, title and interest in: (1) the App; (2) any other product developed by Provider in relation to the App; and (3) any or all of the Intellectual Property Rights contained in them. For the purposes of the Terms, “Intellectual Property Rights” means all patents, copyrights, moral rights, trademark rights, trade secrets and any other forms of intellectual property rights recognized in any jurisdiction, including the application and registration for each from the foregoing.
Provider logos provided through the App are trademarks of Provider and their suppliers or licensors, and may not be copied, imitated or used in whole or in part without the prior written permission of Provider or the respective trademark owner. You cannot use any meta tags, “hidden text”, “Cube ACR” or any other name, trademark or product of a Provider without our prior written permission. In addition, the App, including all page titles, graphics, button icons and fonts, are service marks, trademark and /or design of Provider goods, and cannot be copied, imitated or used in whole or in part without prior written permission. All other trademarks, registered trademarks, product names and company names or logos provided through the App are the property of their respective owners. Mention of any products, services, processes or other information by trademarks, trademarks, manufacturers, suppliers or in any other way does not accept or implies endorsement, sponsorship or recommendation by us.
The App supports the following applications and devices, including, but not limited to:
- Phone calls
- Skype 7, Skype Lite
- Telegram 6, Plus Messenger
Please note: the ability to record VoIP calls depends on the firmware of your devices. There may also be some problems recording calls on Android 9 and Android 10.
The App may present links to third-party websites, products or services (“Third-party Links”). We are not responsible for the availability of these Third-party Links, or the images, messages or other materials contained therein. Provider does not control, endorse or adopt any Third-party Links and makes no representation or warranties of any kind regarding the Third-party Links including, but not limited to, their accuracy or completeness. You acknowledge and agree that Provider is not responsible or liable in any manner for any Third-party Links and undertakes no responsibility to update or review any Third-party Links. App Users interact with such Third-party Links contained therein at their own risk. This provision will survive past the termination of App usage.
The application is available for a license fee. Free trial license can be provided upon request.
Except as expressly provided herein, all payments under this Terms will be irrevocable, non-refundable, and non-creditable.
You must use reasonable security measures in connection with your use of the App. You must comply with the Laws with respect to your use of the App. For the purposes of the Terms, “Laws” means federal, national, state, provincial, municipal and local laws, rules, regulations, court orders, decisions and sentences in each jurisdiction applicable to you or Provider.
Before using the App, you must familiarize yourself with the legislation of your country regarding the recording of calls with the participation of third parties. The legislation regarding phone call recording varies in different countries and states. Please make sure that you're not violating the law of your or your callee/caller country. Always notify the callee/caller that your conversation will be recorded and ask for their permission. Provider is not responsible for the legality of your use of the App.
PROVIDER PROVIDES THE APP “AS IS” AND “AS AVAILABLE” WITHOUT ANY REPRESENTATIONS, WARRANTIES, LIABILITY OR CONDITIONS OF ANY KIND. PROVIDER DOES NOT WARRANT THAT THE APP WILL WORK UNINTERRUPTED WITHOUT ERRORS OR IS TOTALLY SECURE.
YOU ACKNOWLEDGE AND AGREE THAT PROVIDER DOES NOT WARRANT AND WILL NOT BE LIABLE FOR INCORRECT WORK OF THE APP AFTER FIRMWARE UPGRADE OR REPLACEMENT OF YOUR DEVICE BY YOU. WE ARE NOT RESPONSIBLE FOR ANY LOSS OR DAMAGE WHICH MAY BE CAUSED BY THE APP.
IN NO EVENT SHALL PROVIDER BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOSS OF PROFITS, LOSS OF USE, LOSS OF REVENUE, LOSS OF GOODWILL, ANY OBSTACLE TO BUSINESS, OR FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING FROM OR IN CONNECTION WITH THE USE OF THE APP.
You can stop using the App anytime, as well as cancel your license, however, the license fee is non-refundable.
